Why an agreement, not a handshake
Help without a document seems simpler, but it gives both sides less protection. The Law of the Kyrgyz Republic "On countering corruption" (CBD act 230040756, in force, art. 2 part 1 item 2) defines unlawful benefit as any material or non-material advantage, services included, that an official promises, offers, transfers or receives "without lawful grounds" in connection with the use of their official position and "contrary to the interests of the service". A written, public agreement has such grounds; a friendly arrangement does not.
Therefore, we prefer the slow path: agreement, signature, publication. This way, the head of the institution will not have to explain to anyone why outside engineers are looking at the institution's system.
Why this is not public procurement
Public procurement is an acquisition "financed in whole or in part from public funds" (Law of the Kyrgyz Republic "On public procurement", CBD act 112361, in force, art. 3 item 11). Here no public funds are spent, so no tender is required. For the same reason, the foundation does not accept reimbursement of expenses: any payment would turn help into procurement with all its procedures and deadlines.
